1. Services Provided

English with Ema provides online English language tutoring and educational materials. The specific details of each session (duration, frequency, and curriculum) will be agreed upon at the time of booking.

2. Payments and Refunds

• Payments: All fees must be paid in full before the start of a session or a bundle of classes, unless otherwise agreed in writing.

• Pricing: We reserve the right to change our prices at any time. Price changes will not affect sessions already paid for.

• Refunds: Refunds are generally not provided for completed sessions. For pre-paid bundles, refunds for unused sessions may be requested within 14 days of purchase, subject to a small administrative fee.

3. Cancellation and Rescheduling Policy

• Student Cancellations: You must provide at least 24 hours’ notice to reschedule or cancel a session without penalty.

• Late Cancellations: Cancellations made with less than 24 hours’ notice, or “no-shows,” will be charged the full session fee.

• Tutor Cancellations: If the tutor needs to cancel, you will be offered a full refund for that session or the option to reschedule at your convenience.

4. Intellectual Property

All materials provided during tutoring (PDFs, exercises, recordings, and videos) are the intellectual property of English with Ema. These materials are for your personal, non-commercial use only. You may not record, distribute, or sell any part of the lessons or materials without prior written consent.

5. Code of Conduct

We maintain a professional and respectful learning environment. We reserve the right to terminate services immediately, without a refund, if a student engages in:

• Harassment or discriminatory behavior.

• Obscene or inappropriate language/conduct during sessions.

6. Limitation of Liability

To the maximum extent permitted by law, English with Ema shall not be liable for any indirect, incidental, or consequential damages resulting from your use of our services. Our total liability for any claim arising out of these Terms shall not exceed the amount you paid us in the three (3) months preceding the claim.

7. Disclaimer of Warranties

Our services are provided “as is.” While we strive for excellence, we do not guarantee specific results (e.g., passing a specific exam or achieving fluency within a set timeframe). Your progress depends on your individual effort and participation.

8. Governing Law and Arbitration

• Governing Law: These Terms are governed by the laws of Portugal, without regard to conflict of law principles.

• Dispute Resolution: Any dispute arising from these Terms will be resolved through binding arbitration, rather than in court. You waive your right to participate in a class-action lawsuit or class-wide arbitration.

9. Modifications to Terms

We may update these Terms from time to time. We will notify you of any changes by posting the new Terms on this page. Your continued use of the services after changes are posted constitutes your acceptance of the new Terms.
